Edmonson, Superintendent News Release Date: October 30, 2008 Keeping Our Children Safe During Halloween Halloween is a time of fun and enjoyment as we watch our children take a break from even their busy life (i.e. school and sports) and just be “children” for a few hours. However, it is the responsibility of parents and all law enforcement to assure that Halloween activities are enjoyable and free from mishaps and tragedies. The Department of Public Safety and Corrections is actively engaged in keeping children safe during Halloween. Sex offenders are not allowed to participate in any Halloween activities. All supervised sex offenders who are not working Halloween night must be at home with all outside lighting turned off. They are not allowed to open their doors to trick-or-treaters. Probation and Parole Officers will be performing random spot checks to ensure sex offenders are at home and following the rules/guidelines that pertain to them. Prior to Halloween activities parents can visit our web site ( www.lsp.org ) to search for registered sex offenders in their area. If a sex offender is participating in Halloween activities parents/citizens are urged to contact their local law enforcement agency or us. For details regarding the specific law see below. Act 400 signed into law on 8/15/08: Applies only to TIER 2 and TIER 3 Offenders. (25 year and lifetime registrations) E. Every person convicted of or who pleads guilty to a sex offense specified in R.S. 24:932, is prohibited from using or wearing a hood, mask or disguise of any kind with the intent to hide, conceal or disguise his identity on or concerning Halloween, Mardi Gras, Easter, Christmas, or any other recognized holiday for which hoods, masks, or disguises are generally used. §313.1. Distributing candy or gifts on Halloween and other public holidays by "sex offenders" prohibited; penalty It shall be unlawful for any person convicted of or who pleads guilty to a sex offense specified in R.S. 24:932 to distribute candy or other gifts to persons under eighteen years of age on or concerning Halloween, Mardi Gras, Easter, Christmas, or any other recognized holiday for which generally candy is distributed or other gifts given to persons under eighteen years of age. Whoever violates the provisions of this Section shall be sentenced to a term of imprisonment of not less that six months nor more than three years. Additional safety guidelines are as follows: 1. Children should wear some type of reflective clothing. 2. Flashlights or “glow sticks” should be utilized for safety. 3. Only trick-or-treat with a group! Never trick-or-treat by yourself! 4. Parents should supervise all children. 5. Parents should perform a visual check of all candy prior to allowing their children to consume it.
